Terms of Service

These Terms of Service (“Terms”) govern your access to and use of GovX, the Governance and Political Consulting Unit of Bharat Innovation Lab, operated by BharatX Innovation Lab Private Limited (“Company”, “we”, “us”, or “our”).

By accessing or engaging with GovX services, platforms, content, or engagements, you agree to be bound by these Terms.

1. About GovX

GovX is the governance and political consulting unit of Bharat Innovation Lab, providing strategic communication, technology-enabled solutions, and grassroots mobilization support for:

  • Electoral campaigns
  • Political leadership offices
  • Governance and public service delivery
  • Political parties, candidates, and alliances
  • Government and public institutions (pre- and post-election)

GovX works across the entire lifecycle of leadership- from campaign strategy and voter outreach to governance design, citizen engagement, and implementation support.

3. Eligibility and Authorized Engagement

GovX services are available only to:

  • Authorized political candidates, parties, alliances, or representatives
  • Elected representatives and their offices
  • Government departments or public institutions
  • Authorized agents, campaign managers, or officials

You represent and warrant that:

  • You are legally authorized to engage GovX
  • Your engagement complies with applicable election laws, codes of conduct, and regulations
  • All information shared with GovX is lawful and accurate

4. Nature of Services

GovX services may include, but are not limited to:

4.1 Strategic Communication

  • Campaign messaging and narrative design
  • Political branding and positioning
  • Media, digital, and ground communication strategy
  • War-room and rapid-response support

4.2 Technology and Data Support

  • Voter outreach systems and analytics
  • Campaign dashboards and monitoring tools
  • Feedback, grievance, and sentiment analysis systems
  • Digital mobilization and volunteer coordination

4.3 Grassroots Mobilization

  • Booth-level and cadre strategy
  • Volunteer and field force structuring
  • Community engagement frameworks
  • Issue-based and constituency-level interventions

All services are advisory and execution-support in nature and may be governed by separate proposals, contracts, or Statements of Work.

5. No Guarantee of Electoral Outcome

You expressly acknowledge that:

  • GovX does not guarantee electoral victory, governance outcomes, or political success
  • Electoral results depend on multiple external factors beyond our control
  • All strategies, insights, and recommendations are provided on a best-effort, professional basis

This clause is fundamental to the engagement.

6. Compliance with Laws and Election Regulations

Clients and users agree to:

  • Comply with the Representation of the People Act, 1951
  • Adhere to Election Commission of India (ECI) guidelines and Model Code of Conduct
  • Ensure lawful use of data, funds, communications, and volunteers

GovX shall not be responsible for misuse of strategies or tools in violation of law.

7. Confidentiality

GovX engagements involve sensitive political, electoral, and governance information. All parties agree:

  • To maintain strict confidentiality
  • Not to disclose strategies, data, or internal communications
  • To use information solely for authorized purposes

Confidentiality obligations survive termination of engagement.

8. Data and Information Responsibility

  • Clients remain responsible for legality of data shared with GovX
  • GovX may process data solely for campaign or governance support
  • Aggregated or anonymized insights may be used for internal research

GovX does not claim ownership over client political data.

9. Intellectual Property

All frameworks, playbooks, methodologies, tools, dashboards, and materials developed by GovX remain the intellectual property of Bharat Innovation Lab unless otherwise agreed in writing.

Clients receive a limited, non-transferable right to use deliverables for the agreed purpose only.

10. Disclaimers

  • Services are provided on an “as is” basis
  • GovX does not provide legal, electoral compliance, or statutory advice
  • Final decisions and accountability rest with the client or authority

We disclaim all warranties to the extent permitted by law.

11. Limitation of Liability

To the maximum extent permitted under Indian law:

  • GovX shall not be liable for indirect or consequential damages
  • Total liability shall not exceed fees paid under the relevant engagement

12. Indemnification

You agree to indemnify and hold harmless Bharat Innovation Lab and GovX against claims arising from:

  • Unlawful political activity
  • Breach of election laws or regulations
  • Misuse of strategies, tools, or communications

13. Suspension and Termination

GovX may suspend or terminate services:

  • For breach of these Terms
  • For legal or regulatory risks
  • Upon instruction from competent authority

Termination does not affect confidentiality or accrued obligations.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Courts at New Delhi, India shall have exclusive jurisdiction.

15. Amendments

We may revise these Terms periodically. Continued engagement constitutes acceptance of revised Terms.
